Two similar cases have been decided in favor of online gambling operators.
In the first case, Germany and its state of online gambling monopoly under the current system, only 16 federal states could offer online gaming services, other suppliers are considered illegal. The Court ruled that, given the current German rules do not allow to limit the supply of game consistent and systematic manner, preventive objective of such a monopoly is not reached and the monopoly of state thus ceases to be justifiable.
In the second case, the European Court of Justice ruled against the Austrian legislation which required operators of online gambling have their headquarters in the country. The Court stated that it was against the freedom of establishment to have such an obligation, contrary to the principle of equal treatment, in addition to being indirect discrimination prohibited by the laws of the European Union.
